Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, applications, and services (collectively, the “Service”) provided by Kairo (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

  • You must provide a valid email address to create an account via our passwordless magic-link sign-in.
  • You are responsible for maintaining the security of your account and for all activity that occurs under it.
  • You agree to notify us immediately at support@kairo.ai if you suspect unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of the Service

Kairo provides AI-powered career tools, including but not limited to:

  • Resume generation and optimization.
  • LinkedIn profile analysis and rewriting.
  • Portfolio website generation.
  • Cover letter drafting.
  • PDF export of generated materials.

The Service uses third-party artificial intelligence models to generate content based on information you provide. We do not guarantee the accuracy, completeness, or suitability of AI-generated outputs (see Section 9).

4. Your Content

4.1 Ownership

You retain all ownership rights to the content you upload, enter, or submit to the Service (“Your Content”), including resumes, work history, education, skills, and any other career-related information.

4.2 License to Us

By submitting Your Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, store, and transmit Your Content solely as necessary to provide and improve the Service. This license terminates when you delete Your Content or your account.

4.3 AI-Generated Output

Content generated by the Service based on Your Content (“Output”) is owned by you, subject to the following:

  • You are solely responsible for reviewing, editing, and verifying all Output before using it for any purpose (e.g., job applications, publication).
  • Similar or identical Output may be generated for other users who provide similar inputs. We do not guarantee exclusivity.
  • You may not claim that Output was created by a human when disclosure of AI involvement is required by law or policy.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Submit false, misleading, or fraudulent information (e.g., fabricated work experience or credentials).
  • Attempt to reverse-engineer, decompile, or extract the source code or underlying models of the Service.
  • Use automated scripts, bots, or scrapers to access the Service without our prior written consent.
  • Interfere with or disrupt the Service or servers connected to it.
  • Resell, sublicense, or redistribute the Service or any Output in bulk as a competing product.
  • Upload content that infringes any third-party intellectual property rights or contains malware.

We reserve the right to suspend or terminate your access if you violate these restrictions.

6. Fees and Payment

  • Kairo may offer free and paid tiers. Pricing, features, and usage limits for each tier are described on our pricing page.
  • Paid subscriptions are billed in advance on a recurring basis (monthly or annually) unless otherwise stated.
  • All fees are non-refundable except as required by applicable law or as expressly stated in a separate refund policy.
  • We reserve the right to change pricing with at least 30 days' notice. Continued use of a paid tier after a price change constitutes acceptance.

7. Intellectual Property

The Service, including its design, code, branding, trademarks, and all underlying technology, is owned by Kairo and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

9. Disclaimers

  • AI limitations: The Service uses artificial intelligence to generate career materials. AI-generated content may contain errors, inaccuracies, or omissions. You are solely responsible for reviewing and verifying all Output before use.
  • “As is” basis:The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • No employment guarantee: We do not guarantee that use of the Service will result in job interviews, offers, or employment. The Service is a tool to assist your job search, not a guarantee of outcomes.
  • Third-party services: The Service integrates with third-party providers (e.g., AI model providers, Firebase). We are not responsible for the availability, accuracy, or practices of third-party services.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Kairo and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to:

  • Your use of or inability to use the Service.
  • Any errors, inaccuracies, or omissions in AI-generated content.
  • Unauthorized access to or alteration of your data.
  • Any third-party conduct on or related to the Service.

In no event shall our total aggregate liability exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kairo and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) Your Content.

12. Termination

  • By you: You may delete your account at any time through the Service or by contacting us at support@kairo.ai.
  • By us: We may suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion.
  • Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 4, 9, 10, 11, 13, and 14) will survive.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws provisions.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, either party may pursue binding arbitration administered by a mutually agreed-upon arbitration provider, or, where permitted by law, bring a claim in a court of competent jurisdiction in Delaware.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction.

14. General Provisions

  • Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kairo regarding the Service.
  • Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Modifications:We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new “Last updated” date and, for significant changes, by email. Your continued use of the Service after changes take effect constitutes acceptance.
